1. Agreement

These terms ("Terms") form a binding agreement between you and Kooky LLC, a Delaware limited liability company ("kooky", "we", "us"). By accessing kooky.surf or any content we publish, you accept these Terms.

If you don't agree, don't use the site. Continued use after updates means you accept the revised Terms.

2. The site

kooky.surf is the personal portfolio and operations site of kooky. It showcases live projects (dotesports.gg, queensland.foundation, peaky.broker), publishes occasional notes, and provides a contact channel.

The site is provided as-is and as-available. We may modify, pause, or take down content at any time without notice.

3. Acceptable use

You agree to use kooky.surf lawfully and respectfully. Specifically, you will not:

• Attempt to gain unauthorized access to the site, servers, or related infrastructure
• Use the contact form to send spam, abuse, threats, or unsolicited commercial messages
• Reverse-engineer, decompile, or extract source code from the site
• Misrepresent yourself as kooky, Kooky LLC, or any related entity
• Use the site or our content to mislead, defraud, or harm others
• Violate any applicable law, regulation, or third-party right

4. Intellectual property

All content on kooky.surf — including text, design, code, logos, brand marks, and the avatar — is owned by Kooky LLC or used with permission. The "kooky" name, the wave logo, and related identifiers are trademarks of Kooky LLC.

You may:

• View and read content for personal, non-commercial use
• Share links to kooky.surf pages
• Use the press kit assets in accordance with the brand guidelines published at /brand

You may not:

• Reproduce, modify, or distribute site content without written permission
• Use kooky's brand or trademarks in a way that suggests endorsement or affiliation
• Copy the site design, structure, or code for your own commercial use

5. Linked projects

kooky.surf links to and describes external projects: dotesports.gg, queensland.foundation, peaky.broker. Each of these has its own terms, privacy policy, and operations. By visiting them you agree to be bound by their respective terms.

kooky operates these projects but they are not the same legal entity as Kooky LLC. Inquiries about specific projects should be directed to the project sites.

6. Third-party services

kooky.surf uses third-party services to function:

• Cloudflare — hosting, CDN, security
• Web3Forms — contact form processing
• Google Fonts — typography (Fraunces, Familjen Grotesk, JetBrains Mono)

We don't control these services and aren't liable for their actions or downtime.

7. No warranties

kooky.surf is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We don't guarantee that the site will be uninterrupted, secure, or free of errors. You use it at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, Kooky LLC, its members, officers, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of kooky.surf — including lost profits, lost data, or business interruption.

Our total aggregate liability for any claim related to the site is limited to USD $100.

9. Indemnification

You agree to indemnify and hold harmless Kooky LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the site.

10. Termination

We may suspend or terminate your access to kooky.surf at any time, for any reason, including violation of these Terms. Provisions related to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or your use of kooky.surf will be brought exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction.

12. Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top reflects the most recent revision. Continued use of kooky.surf after a revision means you accept the updated Terms.
